Does a court have to decide our visitation schedule or can the parent decide it for themselves?
Custody along with property in Indiana can be resolved by agreement whether that agreement is reached through settlement negotiations or through mediation. In almost all circumstances the court will approve the settlement negotiations, therefore they will approve any sort of custody arrangement you make as long as the court finds the custody arrangement reasonable. This allows the parties to have the freedom to decide what they think is in their children’s best interest without having the court decide this for them.
