What county do I file for divorce in?

Typically, you’re going to file for divorce in the county where you live. However, there are some requirements to be aware of. In order to file for divorce in Indiana, you have to have lived in Indiana for at least six months and you also need to have lived in the county you filed in for at least three months. So if you have recently moved, you wouldn’t necessarily file in the county where you currently live. Additionally, if your spouse has never resided in Indiana for whatever reason, there are special considerations to take into account and you should advise your attorney at the time of your consultation that your spouse has never resided in the state.
